Why are Sallie Mae loans not forgiven?
That's because Sallie Mae is a private lender now. And despite what you may have heard, there is currently no such thing as private student loan forgiveness.
Those who borrowed from Sallie Mae after this 2014 split have private student loans, which aren't eligible for federal forgiveness programs. However, Sallie Mae will discharge debts for borrowers who die or become totally and permanently disabled.
That's because the U.S. government owns federal loans. Private loans, on the other hand, are funded by lenders such as banks and credit unions. "Lenders and holders of private student loans may establish policies for forgiveness, discharge and cancellation but aren't required by law to do so," Fleischman says.
A False Claims suit was filed against Sallie Mae by former U.S. Department of Education researcher, Dr. Oberg, in 2009. The suit alleges that Sallie Mae and other lenders deliberately overcharged the U.S. government. The findings by Oberg were labeled among higher education policy analysts as the 9.5 scandal.

Unlike with federal student loans, forgiveness rarely applies to private student loans. Some lenders offer student loan forgiveness if you die or become permanently disabled, but not all do. In addition, you'll almost certainly still be on the hook for your private student loan if your cosigner dies.

Private student loans, on the other hand, have a statute of limitations of anywhere from three to 10 years. After this, they become time-barred. The exact time frame depends on your state of residence.
Private student loan holders can't take your tax refunds or Social Security payments, but they can take you to court. If they receive a judgment in their favor, they can garnish money from your paychecks or even your bank accounts to pay your defaulted loan.
Who took over Sallie Mae?
Navient was, at one time, the largest student loan servicer after its parent company Sallie Mae moved its portfolio to it in 2014. Navient ended its federal student loan servicing contract after December 2021 and its portfolio was then transferred to Aidvantage.
Sallie Mae launched Navient in 2014 in order to stay involved with federal loan servicing. Under a separate business entity, Navient could assume Sallie Mae's role and service both federal and private student loans.
Fast-forward 40+ years to 2014 when, thanks to government regulations, Sallie Mae was no longer allowed to offer both private and federal loans. So the company split in two: Sallie Mae would handle private loans and Navient would service federal loans for the government.
Typically, prequalifying for a student loan includes a soft credit check, which does not affect your credit score. Thus, if you apply for a loan with Sallie Mae, a hard credit check will be done, which could temporarily hurt your credit score.

Private student loans can't be forgiven through any government or independent programs. Only federal student loans are eligible for forgiveness under federal programs, laws, and policies.
Borrowers who have reached 20 or 25 years (240 or 300 months) worth of eligible payments for IDR forgiveness will see their loans forgiven as they reach these milestones. ED will continue to discharge loans as borrowers reach the required number of months for forgiveness.
Loan forgiveness and discharge options are limited on private loans and differ from federal loans. Please call us to discuss eligibility for forgiveness or discharge options for private loans. If you have a Total and Permanent Disability (TPD), you may qualify for a TPD discharge of certain private student loans.
Navient was one of the largest federal student loan servicers prior to ending its contract after Dec. 31, 2021. Its loans were transferred to Aidvantage. Navient still services some FFELP loans and private student loans from various lenders.
How do I know if my student loans are forgiven? If you qualify for loan forgiveness under PSLF, Teacher Loan Forgiveness or IDR discharge, the loan servicer or Department of Education will send you a notification letter. Depending on your account settings, you may receive the letter electronically or via mail.
Why are my student loans showing paid in full?
You may notice your former servicer has cleared your loan account. For example, your loan balance may come up as “paid in full” on your former servicer's website or on your credit report. This does not mean you've received loan forgiveness. This is part of the loan transfer process.
Under the terms of the settlement, Navient will cancel the remaining balance on $1.7 billion in subprime private student loan balances owed by more than 66,000 borrowers nationwide. In addition, Navient will pay $142.5 million to the attorneys general.
Navient is a private company that the U.S. Department of Education once hired to service its federal loans. In March 2021, after four years of litigation, a settlement was reached between Navient and the attorney general's office in Washington, where a judge ruled that Navient violated the Consumer Protection Act.

Generally speaking, negative information such as late or missed payments, accounts that have been sent to collection agencies, accounts not being paid as agreed, or bankruptcies stays on credit reports for approximately seven years.
