Can private loans be forgiven?
The only times private student loans can currently be forgiven are in the cases of death or permanent disability—but even in those instances, discharge is typically dependent on your lender's policy.
Private student loans are rarely forgiven. Generally, it only happens if the borrower becomes permanently disabled or dies. If you have a private student loan, you won't receive forgiveness after working in a public service industry and paying down your balance over a certain number of years.
Filing for Bankruptcy
You can discharge federal and private student loans in bankruptcy. Bankruptcy is often considered a last resort option because of the impacts it can have on your credit and the costs and time involved in filing for bankruptcy.
If your personal loan is unsecured, which is often the case, the lender doesn't have any collateral to seize if you fail to repay. As mentioned previously, however, a collection agency may try to sue you for the unpaid amounts you owe, attempt to garnish your wages, or place a lien on your home through a court order.
Since private student loans come from private financial institutions, it's not possible to transfer private student loans into federal ones. However, it may be possible to get some federal-like benefits on your private loan, such as forbearance if you run into financial hardship.
Federal student loan forgiveness programs
The federal government's 20-year loan forgiveness programs are part of the income-driven repayment plans they offer. These are special benefits provided to federal student loan borrowers, and aren't available to people with private loans.
Private student loans, on the other hand, have a statute of limitations of anywhere from three to 10 years. After this, they become time-barred. The exact time frame depends on your state of residence.
Private lenders may attempt to collect on your debt directly, or they may hire collection agencies to try to collect on your debt. In addition, they may take you to court. You should review your private loan contracts carefully to better understand what rights you have if you are worried about going into default.
Although there currently is no such thing as Sallie Mae private student loan forgiveness, there are alternatives available to borrowers struggling to manage their private loans. Private lenders don't offer income-driven repayment plans.
Do student loans go away after 7 years? While negative information about your student loans may disappear from your credit reports after seven years, the student loans will remain on your credit reports — and in your life — until you pay them off.
Do private student loans show up on credit report?
While you're not required to make any payments on federal student loans until after you graduate, both federal and private student loans will show up on your credit report as soon as you're approved for the loan.
Summary: Even if the statute of limitations on your student debt has passed, the debt can still show up on your credit report for up to seven years. There is no statute of limitations on federal student loans, but private student loans have an average statute of limitations of six years.
This option is only available to consolidate federal student loans, such as commercially-held Federal Family Education Loans (FFEL). You cannot consolidate private student loans into federal Direct Consolidation Loans.
Refinancing is available for both federal and private student loans, although the process may differ depending on which loan types you have. It's also important to note that refinancing with a private lender is a different process than loan consolidation with a federal lender.
That said, private student loans aren't without limitations. For example, you won't get access to income-driven repayment plans, loan forgiveness options (if you're eligible) and the other benefits that come with federal loans. You could also spend more than you anticipated in interest if you have a lower credit score.
Loan forgiveness and discharge options are limited on private loans and differ from federal loans. Please call us to discuss eligibility for forgiveness or discharge options for private loans. If you have a Total and Permanent Disability (TPD), you may qualify for a TPD discharge of certain private student loans.
The Education Department will forgive your remaining loan balance after you pay on your loans for 25 years under one of its income-driven repayment plans. This benefit, known as IDR forgiveness, applies only to federal student loan borrowers. Lenders don't cancel private student loans after several years of payments.
Borrowers who have reached 20 or 25 years (240 or 300 months) worth of eligible payments for IDR forgiveness will see their loans forgiven as they reach these milestones. ED will continue to discharge loans as borrowers reach the required number of months for forgiveness.
For private student loans, these periods generally range from three to 10 years. After that, the debt is considered “time-barred” and the lender can no longer bring legal action against you. Exactly when the clock starts also varies by state.
Are my Sallie Mae student loans private or federal? As mentioned above, if you borrowed a Sallie Mae loan after 2014 — or if Sallie Mae is still the current owner of your debt — you have private student loans and aren't eligible for federal student loan forgiveness programs.
What type of student loans can be forgiven?
Public Service Loan Forgiveness. Public Service Loan Forgiveness is available to government and qualifying nonprofit employees with federal student loans. Eligible borrowers can have their remaining loan balance forgiven tax-free after making 120 qualifying loan payments.
Delinquency and default
Delinquency occurs when you fail to pay all or part of your monthly student loan payment. You may be charged late fees for delinquency, which can add to your Total Loan Cost. You may lose any interest rate reduction programs you were eligible for.
If you don't make your student loan payment or you make your payment late, your loan may eventually go into default. If you default on your student loan, that status will be reported to national credit reporting agencies. This reporting may damage your credit rating and future borrowing ability.
Zero balance – the Education Department may have forgiven the student loan debt, but what's more likely is that the loans were moved to a different servicer. Disappeared – the loans defaulted several years ago and fell off the report.
The federal government won't take your home because you owe student loan debt. However, if you default and the U.S. Department of Education cannot garnish your wages, offset your tax refund, or take your Social Security Benefits, it may sue you.
